Marvel and DC used to own the trademark, but that's been broken. Its basically public domain, and everyone owns the term. I wonder if Marvel and DC took a look around at just how much it *was* used, and decided it wasn't worth the cost (and MASSIVE backlash) to try to wrest it back. Christopher R Taylor Posted October 4 Author Report Share Posted October 4 Well the biggest legal flaw in their argument is that two competing companies cannot co-hold a trademark, it makes no sense. Basically they finally faced someone with the money and determination not to back down -- and the "big two" are bankrupt these days, they lack the power to enforce their will any longer.
