Looks like a young killdeer to me . . . the adults usually protect the nest by acting like they have a broken wing and try to lead the threat away from the nest, then fly back.  They nest on the ground in relatively open fields and usually clutch 4 or 5 eggs (in the nests I've found, anyway).  Around here, we occasionally get pairs trying to nest in or alongside gravel driveways and in fields that are grazed down by cattle.
