The first amendment is often misunderstood. Let me start with this: First Amendment Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances. Now, there are parts of the amendment that focus on religion, and protesting, which can be considered a form of speech, but I want to focus specially on the what freedom of speech means in the context. The amendment protects the press and their ability to criticize the government. To say that differently, news organizations both operate independently from, and are constitutionally permitted to be critical of the government. While it is often taken to mean, one can say anything they want, freedom of speech, does not mean freedom from consequences. One cannot should fire in a movie theater causing a panic and use the first amendment as a shield for their actions. This also means that private platforms, such as Facebook, Twitter, or YouTube, can regulate speech based on whatever criteria they set. The Legal Eagle channel has some great videos around this topic. The question was posed, what types of restrictions should be imposed on freedom of speech. This is an interesting idea, and I think my answer would fall on the idea of what constitutes a news source. There was a study that showed people, on average, who primarily consumed Fox News over other news outlets were less informed than people consuming no news coverage at all. The university conducting the study ran the study a second time with a larger sampling of people because they could not believe the results. More recently, Fox News successfully defended themselves by arguing quote: The "'general tenor' of the show should then inform a viewer that [Carlson] is not 'stating actual facts' about the topics he discusses and is instead engaging in 'exaggeration' and 'non-literal commentary.' " So, here's my take, if your organization actively misinforms their viewers, they should not be considered a news source, be allowed to claim they are a news source, nor maintain protections under the first amendment. More so, any claims from such organizations that they are reporting as news would be considered liable in potential litigation, i.e. you cold not use the Tucker Carlson defense.
