Technically not, but if it is a joint account, say with a spouse, and the spouse might be a suspect, it could be reasonably argued that there was an expectation of privacy on the part of the surviving account holder, and any evidence recovered without the warrant might be excluded. Rule of thumb: when in doubt, get a warrant. Or as my mentor in college said a thousand times, "Better to have it and not need it than need it and not have it." eightiesboi Posted December 3, 2009 Report Share Posted December 3, 2009 Re: Pulling Financials Hi, Without getting too technical (message me if you really want the legal details), although there are situations in which the police may not legally need a warrant to get information like bank records, the bank is (usually) under no obligation to comply with the request. In fact, the bank may require a warrant before turning over bank records both to protect themselves from liability as well as to avoid a public relations problem. The earliest cite I've heard for the "have it and not need it" quote was in Arkansas in 1836, when a newcomer asked an Arkansawyer why he carried a gun.
