This looks interesting, and very useful if you want to run a campaign where accountability is a serious concern.  My only concern is that it might be going too deeply into the weeds, where a slightly higher-level view might be better.  It also sounds like it's rooted in actual US law, when the existence of powers could *easily* require extensive changes, and even deeply challenge the notion of treating everyone equally.  Someone who can wave their hand and cause a car to explode requires rather more to be considered safely restrained than a normal bomber.

   Comic Buyers Guide a newspaper for comic collectors that folded up shop about 15 years ago used to run a column called “The Law is an Ass” (the title taken from a Shakespeare quote) by comics writer Robert Ingersoll who also happened to be a lawyer. Each week would be about some legal point that came up in the comics world whether it was Daredevil’s secret ID Matt Murdock bungling a case or how Benton Quest kept Children’s Services from taking Jonny Quest away from a home where he was allowed to go into dangerous situations every week. 
  Always informative and funny, I believe they’re still on line somewhere.

For a higher-level but still useful view, I recommend looking at Hero Games' Stronghold source book. Its author, Steve Long, is as we know a lawyer himself. Besides detailing the Champions Universe's American super-prison, the book devotes about two dozen pages to an overview of the American legal system, particularly its criminal dimension, and discusses how it's adapted to the presence of superhumans. The advice and examples therein are clear and easily digestible, and should be more than sufficient for most gaming needs.
