Again, this comes down to the difference in your mind between "Optional Rule™" and "Rule that is Optional".  Despite Hugh's protestations, Active Point caps are a rule, by every sane definition, they're just not a rule written down in the official rule books.  Just like "in this game you get extra points to build a character with if you bring M&Ms to share" isn't a rule written down in the rulebooks... but its a rule.

When the official rules include standard rules, optional rules and something specified as "are not official Hero System rules in any way; there are no specific instructions for them, or requirements that you institute them," that last "something is not a rule.  The official Hero System rules specifically state that they are not Hero System rules.

 

They go beyond being "not a rule written down in the official rule books" (which is the very definition of a house rule - a rule we use in this game which is not in, or even differs from, the official rules) - they are something which are not rules, as specifically stated in the official rule books.
