It's a borderline case. The university is a public institution. It is bound by the first amendment so in principle it can't expel students for what they say. However the university does have the right and responsibility to keep students from being driven out by other students creating a hostile environment for them. You can not for example harass female students out of class by constantly telling them that women have no place in engineering. This situation wasn't as direct as that. The fraternity leaders were "merely" indoctrinating new members of the frat with the idea that they should keep black students out of the fraternity at all costs with some mention of "lynching" as an acceptable alternative to letting them in. It's possible that the hostility they were instilling would never be passed on to black students who weren't actually trying to apply for membership. 

So personally I'm going with a firm "maybe". An argument can be made but it's not a sure thing in court.
