No, I think its the concept, because it violates one of the basic reality suspension concepts in Comic books: Superheroes function outside the law but are allowed to without interference. Once you cross that line it just starts to suck and all kinds of essential comic tropes are violated like secret identities and not having long drawn out court scenes as the bad guys are tried and evidence is gathered. The point of superheroes is to bypass all that and cut straight to the justice.
Civil War makes sense in the real world, but sucks in comic books. The entire conflict violates the principles of superheroes that make it work.

Yeah the designers have made noises that they regret ever adding flight into the game. Their complaint? Well aside from most of them being PVP'ers and hating having someone fly in suddenly from above to attack them on PVP servers - something only a small minority of idiots players play on - it allows players to bypass the hard, slow slog through hordes of monsters on the ground and annoying terrain designed to slow down your play time.
If there's one thing game designers hate, from the very beginning of MMOG's (you used to get banned in EverQuest for doing it), its "bypassing content." Bypassing content means "not fighting your way through mile after mile of crap to get to where you want to be."
Now, honestly, I don't mind going through that once, with one character. You see the story, learn about the territory, etc. Its okay. But when you have multiple, sometimes dozens of alts... yeah, not real fond of it.

Christopher you mentioned about buying some if these module. I bought the To Serve and Protect module years ago and it had a blank page every other sheet! Lol (I knew the condition of the module when I bought it. Someday I'll get a new copy.)
