At the end of the episode not only is he not charged as an accessory to her crimes but says that now that she was defeated as a man and returned to the body of a woman “she’ll be alright now” and that he would help care for her. But in the way of extenuating circumstances, Khan is incredibly charismatic, and accustomed to taking what he wants, breaking down opposition. He's also McIvers' fantasy man from the past brought to life, and he recognizes and uses that. And there are still plenty of people who respond to this sort of thing. This whole domination thing is a fantasy that a lot of people instinctively respond to, even if they wouldn't want that to happen to them in real life. Kind of like those who like watching a movie about a mad slasher. Films can provide a safe and consequence-free way to enjoy what that part of our brain enjoys, whether or not we would want or even approve of the reality of it.
