Actually ... I'd have to push numbers around to confirm if this is possible.  Earth is inferior to (in the sense of orbiting the Sun closer than) Mars, so it can't appear in Mars's midnight sky.  I'd have to find out what its maximum elongation angle is, and see if the twilight would be that deep.  Now, Mars's atmosphere is rather scrawny, so the twilight there isn't much to speak of anyway.  Have to see if we still have access to a desktop planetarium facility that can produce views from other planets.

I get 33º for elongation using this online calculator but I may be setting up the geometry wrong.

 

But it's also not clear what the focal length of the photo is.  If it's a really tight shot then Earth is not that far above the horizon.
